Federal agencies demand records from SeaWorld theme park

Sea World subject of federal probes related to CNN’s ‘Blackfish’ documentary

The Department of Justice and the Securities and Exchange Commission have subpoenaed SeaWorld regarding some of its statements on the movie, according to a regulatory filing on Friday, June 23.

A newspaper is reporting that two federal agencies are demanding records from SeaWorld.

The filing states that the company's board of directors formed a special committee earlier this month to help SeaWorld respond to the inquiries. Activists say the large animals were inhumanely treated by keeping them in small tanks, when they should be kept at sea in pens. It details alleged mistreatment of orca whales by SeaWorld workers, and it led to massive amounts of backlash.

The chairman offered to resign immediately after the meeting, but the board chose to keep D'Alessandro through the end of the year, when he'll step down, the company said in Friday's filing.

In response to a question during a call to discuss its quarterly results in March 2014, then-Chief Executive Jim Atchison said the company had seen "no noticeable impact on our business", and that national surveys and data collected by the company "don't reflect any shift in sentiment about intent to visit our parks".

Seaworld, which has reported falling revenues for the last three years, said in 2016 it would stop breeding killer whales in captivity.

The same filing noted that the board took the matter into consideration, among other factors, when it decided this month to accept the resignation of board chairman David D'Alessandro, who did not receive a majority vote at the company's annual shareholder meeting. The Justice Department and SeaWorld declined to comment, and the SEC did not immediately respond to inquiries from the media.
